According to NBC, Benjamin Golden, 32, is suing driver Edward Caban for $5 million, saying Caban illegally recorded the entire incident.
Golden’s lawyer Courtney Pilchman is also seeking to have the video of the attack barred from evidence in the criminal case agains Golden.
Back in November, Golden offered Caban a tearful apology for his actions. Caban rejected Golden’s apology.
Pilchman described Caban as an “opportunist,” and questioned his claim that he suffers from post-traumatic stress because of the attack.
Golden claims the “overwhelming media coverage” of the video has caused him “severe emotional distress, humiliation, anxiety, fear, pain and suffering and the loss of his job.”
